cyberdash.net (hereinafter – "Service", "we", "us" or "our") respects your privacy and is committed to protecting your personal data. This privacy notice will inform you as to how we look after your personal data when you use our cyberdash.net and tell you about your privacy rights and how the law protects you.

By using our Service, you acknowledge that for specific features (specifically "CyberTube") we utilize YouTube API Services.

You will be required to read and accept this Privacy Policy when signing up for your cyberdash.net Account or filling the form on cyberdash.net. BY USING THE cyberdash.net, YOU PROMISE US THAT (I) YOU HAVE READ, UNDERSTAND AND AGREE TO THIS PRIVACY POLICY, AND (II) YOU ARE OVER 18 YEARS OF AGE (OR HAVE HAD YOUR PARENT OR GUARDIAN READ AND AGREE TO THIS PRIVACY POLICY FOR YOU). If you do not accept and agree with this Privacy Policy, you must stop using cyberdash.net immediately.

CHANGES TO THE PRIVACY NOTICE AND YOUR DUTY TO INFORM US OF CHANGES

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

We reserve the right to and may change this Privacy Policy from time to time. If we make any material changes, we will notify you through the cyberdash.net, or by presenting you with a new version of this Privacy Policy for you to accept, if we, for example, add new processing activities or collect some additional Personal Data from you. Your continued use of the cyberdash.net after the effective date of an updated version of the Privacy Policy will indicate your acceptance of the Privacy Policy as modified. In some cases, you will have to accept changes to the Privacy Policy explicitly.

PERSONAL DATA YOU PROVIDE TO US AND THE DATA WE COLLECT ABOUT YOU

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may automatically collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  • Identity Data: includes first name, last name (if provided in your profile).
  • Contact Data: includes email address and account credentials (processed via Firebase).
  • Device Data (Technical Data): includes hardware model information about the operating system and its version, unique device identifiers (e.g., IDFA), device storage information, internet protocol (IP) address, and browser type.
  • Location data: includes internet protocol (IP) address, language, time zone setting and approximate location (used specifically to provide accurate weather information via our weather widget).
  • Usage Data: includes information about how you use our cyberdash.net, blog and services, and the website from which you visited us from.
  • YouTube API Data: When you use "CyberTube" via Google OAuth, we fetch video thumbnails, video duration, video titles, and the video content itself.
  • Marketing and Communications Data: includes your preferences in receiving newsletters (via SendPulse) and marketing from us and our third parties.

    • AGGREGATED DATA

    We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific cyberdash.net feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

    SPECIAL CATEGORIES OF DATA

    We do not collect any Special categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

    HOW WE USE YOUR PERSONAL DATA

    We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the contract, we are about to enter into or have entered into with you.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  • Where we need to comply with a legal or regulatory obligation.
  • Where you have given us specific consent to use your personal information in a specific purpose.

    • If you share with us personal data of third party, you confirm that such third party gave you consent on collection and processing of his/her data by us. We in our turn will take the same measures and procedures to ensure the safety of such information as we do in the relation to your personal data.

    PURPOSES FOR WHICH WE WILL USE YOUR PERSONAL DATA

    MARKETING

    We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising. You can control your choices through the newsletter checkbox or by contacting us.

    CHANGE OF PURPOSE

    We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

    DISCLOSURES OF YOUR PERSONAL DATA

    We may have to share your personal data with the parties set out below for the purposes set out in Section 3 above:

    Internal Third Parties: Companies inside our Group.

    External Third Parties & Subprocessors:

  • Infrastructure & Hosting: OVHCloud (Data centers located in Poland).
  • Authentication & Backend: Firebase (Google LLC).
  • Payment Processing: Stripe, Inc. (All payment data is encrypted and handled by Stripe; we do not store your credit card details).
  • Email Marketing: SendPulse (Email automation).
  • Advertising & Analytics Partners: Google, Inc., Meta Platforms, Inc., home.pl S.A and other. These parties analyze your data and show relevant information about the cyberdash.net to people who might be potentially interested in it or remind you about revisiting the cyberdash.net, if you stopped using it a while ago; or helps us to storage of all Personal Data when you use the cyberdash.net, to understand how you use the Service, engage with particular features and what you like or dislike the most to generate statistical reports.
  • API Services: YouTube API Services (Google LLC).

    • Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets.

    We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

    Opt-out options: You can withdraw your consent or opt-out anytime by contacting us at support@cyberdash.net.

    DATA SECURITY

    We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

    We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

    DATA RETENTION

    We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

    To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure, and the applicable legal requirements.

  • Inactive Accounts: We will delete your account and all associated personal data after 12 months of continuous inactivity.
  • YouTube API Data: We store video metadata fetched via API for a maximum of 24 hours.
  • Financial Records: Payment-related data (Stripe) is retained for 5 years to comply with Polish accounting and tax laws.
  • Newsletter Data: Retained until you withdraw your consent or unsubscribe.

    • Not collected Identity Data may be deleted by you at any time. In some circumstances you can ask us to delete your data (see Section 7). We may anonymise your personal data for research or statistical purposes in which case we may use this information indefinitely.

    YOUR LEGAL RIGHTS

    Under certain circumstances, you have rights under data protection laws in relation to your personal data.

    You have the right to:

  • Request access to your personal data (data subject access request).
  • Request correction of the personal data that we hold about you.
  • Request erasure of your personal data. You have the right to ask us to delete or remove personal data where there is no good reason for us continuing to process it. (Note: Currently handled via request to support@cyberdash.net).
  • Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party).
  • Request restriction of processing of your personal data.
  • Request transfer (Data Portability): You have the right to receive a copy of your personal data. Upon request via support@cyberdash.net, we will provide your data in a structured, commonly used, and machine-readable format (JSON or CSV).
  • Withdraw consent at any time where we are relying on consent to process your personal data.

    • No fee usually required: You will not have to pay a fee to access your personal data. However, we may charge a reasonable fee if your request is clearly repetitive or excessive.

    What we may need from you: We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it.

    Time limit to respond: We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex.

    GLOSSARY

    LAWFUL BASIS

    Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).

    Performance of contract means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.

    Comply with a legal or regulatory obligation means processing your personal data where it is necessary for compliance with a legal or regulatory obligation that we are subject to.

    CALIFORNIA PRIVACY RIGHTS (CCPA)

    This section applies only to residents of California, United States. Under the California Consumer Privacy Act ("CCPA") and California's Shine the Light law:

    For more details about the personal information we have collected, please see Section 2 above. We collect this information for purposes described in Section 3. We may also share your information with certain categories of third parties as indicated in Section 4.

    Subject to certain limitations, the CCPA provides California consumers the right to request to know more details about the categories or specific pieces of personal information we collect, to delete their personal information, to opt-out of any "sales" that may be occurring, and to not be discriminated against for exercising these rights.

    We do not sell your personal information. California consumers may make a request pursuant to their rights under the CCPA by contacting us at support@cyberdash.net. We will verify your request and inform you accordingly. You may also designate an authorised agent to exercise these rights on your behalf.

    Our Service (specifically the "CyberTube" feature) uses YouTube API Services. By using these features, you agree to be bound by the following:

    EXCLUSIVE USE OF GOOGLE OAUTH

    Your Google Account authorization is used solely and exclusively for the operation of the CyberTube service to provide you with personalized recommended videos and related content. We do not use this access for any other purposes within the Service, and we do not share this specific access with third parties except as necessary for the API functionality. We only access the specific metadata mentioned in Section 2.
